Malaysia to Introduce Public Health Smoking Control Act 2023

The Malaysian Health Minister confirms the submission of the Tobacco and E-Cigarette Control Bill before November 30th.

According to a report in The Star on November 19th, the Malaysian Minister of Health has confirmed that the draft of the Public Health Smoking Control Act 2023 (GEG) will be submitted before the end of this current parliamentary session on November 30th.

The Ministry of Health is currently seeking to prohibit anyone born on or after January 1, 2007 from using tobacco and e-cigarette products. Despite Health Minister Dr. Zailiha Mustafa confirming this plan, Attorney General Tan Sri Mohamed Apandi Ali has pointed out that the proposed law violates Article 8 of the Malaysian Constitution, as it creates unequal treatment under the law between individuals born before and after the specified date.
